1. Acceptance of Terms
By accessing or using TruSkill ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Service.
2. Description of Service
TruSkill is a career trust platform that makes your judgment, ownership, and progress visible over time. The Service helps you build credibility through consistent progress - demonstrating the trajectory that drives promotions and career advancement.
3. User Accounts
To use certain features of the Service, you must create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
3.1 Account Requirements
You must provide accurate and complete information when creating your account. You must be at least 18 years old to use the Service.
3.2 Account Security
You are responsible for safeguarding your account and must notify us immediately of any unauthorized use or security breach.
4. User Content
You retain ownership of content you submit to the Service. By submitting content, you grant TruSkill a non-exclusive, worldwide license to use, store, and process your content solely for the purpose of providing the Service.
5. Acceptable Use
You agree not to use the Service to:
- Violate any applicable laws or regulations
- Infringe on the rights of others
- Submit false or misleading information
- Attempt to gain unauthorized access to the Service
- Interfere with or disrupt the Service
6. Intellectual Property
The Service and its original content, features, and functionality are owned by TruSkill and are protected by international copyright, trademark, and other intellectual property laws.
7. Termination
We may terminate or suspend your account at any time, without prior notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties, or for any other reason at our sole discretion.
8. Disclaimer of Warranties
The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
9. Limitation of Liability
In no event shall TruSkill be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Service.
10. Changes to Terms
We reserve the right to modify these Terms at any time. We will notify users of any material changes by posting the updated Terms on the Service. Your continued use of the Service after such changes constitutes acceptance of the new Terms.
11. AI-Powered Services
The Service uses artificial intelligence and machine learning technologies to provide personalized career insights and recommendations. You acknowledge that:
- AI-generated content is provided for informational purposes only and should not be considered professional career advice
- AI outputs may occasionally be inaccurate, incomplete, or biased
- You are responsible for verifying any AI-generated recommendations before acting on them
- We may use anonymized and aggregated data to improve our AI models
- We use third-party AI services (such as OpenAI, Anthropic) to power certain features, subject to their respective terms and privacy policies
12. Beta Services
TruSkill is currently in beta. Beta services are provided "as is" and may contain bugs, errors, or other issues. We reserve the right to modify, suspend, or discontinue beta features at any time without notice. Data created during beta may be subject to changes in data models or formats. We will make reasonable efforts to preserve your data but cannot guarantee complete data continuity during the beta period.
13. Indemnification
You agree to indemnify, defend, and hold harmless TruSkill, its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising out of or related to your use of the Service, your violation of these Terms, or your violation of any rights of another party.
14. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions. You agree to submit to the personal and exclusive jurisdiction of the courts located in Delaware for the resolution of any disputes.
15. Dispute Resolution
Any dispute arising from or relating to these Terms or the Service shall first be attempted to be resolved through good-faith negotiation. If negotiation fails, disputes shall be resolved through binding arbitration administered by the American Arbitration Association under its Commercial Arbitration Rules. The arbitration shall take place in Delaware, and the arbitrator's decision shall be final and binding.
Class Action Waiver: You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action. You waive any right to participate in a class action lawsuit or class-wide arbitration.
16. Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.
17. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and TruSkill regarding the Service and supersede all prior agreements and understandings, whether written or oral.
